FluffNSuds ("FluffNSuds," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy describes how we collect, use, disclose, retain, and safeguard personal information when you visit fluffnsuds.com and any related subdomains, interact with our digital studio services, sign up for our waitlist, or otherwise communicate with us (collectively, the "Services").
This Policy is provided in accordance with applicable United States federal laws and the laws of the Commonwealth of Virginia, including but not limited to the Virginia Consumer Data Protection Act, Va. Code § 59.1-575 et seq. ("VCDPA"), the Federal Trade Commission Act, 15 U.S.C. § 45, the Controlling the Assault of Non-Solicited Pornography And Marketing Act of 2003 ("CAN-SPAM Act"), 15 U.S.C. §§ 7701–7713, the Children's Online Privacy Protection Act ("COPPA"), 15 U.S.C. §§ 6501–6506, the Electronic Communications Privacy Act ("ECPA"), 18 U.S.C. §§ 2510 et seq., and the Computer Fraud and Abuse Act, 18 U.S.C. § 1030.
By accessing or using the Services, you acknowledge that you have read, understood, and consent to the data practices described in this Policy. If you do not agree, you must discontinue use of the Services.
Information We Collect
Information You Provide Directly: We collect personal information you voluntarily submit, including your full name, email address, telephone number, mailing or business address, business name, project details, billing information for paid services, and any content you include in contact forms, waitlist sign-ups, inquiry emails, or other correspondence.
Information Collected Automatically: When you interact with the Services we may automatically collect certain technical information, including your internet protocol (IP) address, device identifiers, browser type and version, operating system, referring and exit URLs, pages viewed, time and date of access, clickstream data, and general geolocation derived from your IP address.
Cookies and Similar Technologies: We and our service providers use cookies, web beacons, pixels, local storage, and similar technologies to operate, secure, and analyze the Services. Categories include strictly necessary cookies, performance/analytics cookies, and functional cookies. See "Cookies and Tracking Technologies" below.
Information From Third Parties: We may receive limited information from analytics providers, email delivery providers, payment processors, hosting providers, and social platforms that you use to contact us.
Sensitive Data: We do not knowingly request or process "sensitive data" as defined under Va. Code § 59.1-575 (including racial or ethnic origin, religious beliefs, mental or physical health diagnosis, sexual orientation, citizenship or immigration status, genetic or biometric data processed for identification, precise geolocation, or personal data collected from a known child) without obtaining your prior consent in accordance with the VCDPA.
How We Use Your Information
We process personal information for the following purposes, each consistent with a legitimate business need or with your consent: (a) to provide, operate, maintain, and improve the Services; (b) to respond to your inquiries, fulfill requests, and provide customer support; (c) to communicate with you about projects, appointments, our upcoming laundromat location, and service updates; (d) to send marketing or promotional communications where you have opted in, in compliance with the CAN-SPAM Act; (e) to process payments and maintain business records as required by federal and Virginia tax and commercial law; (f) to monitor, secure, and protect the Services against fraud, abuse, and unauthorized access; (g) to comply with legal obligations, court orders, subpoenas, and regulatory requests; and (h) to establish, exercise, or defend legal claims.
We do not engage in "profiling in furtherance of decisions that produce legal or similarly significant effects" concerning you, as that term is defined under the VCDPA. We do not "sell" personal data in exchange for monetary consideration, and we do not process personal data for purposes of targeted advertising as those terms are defined under Va. Code § 59.1-575.
Legal Bases and Disclosures of Information
We may disclose personal information to the following categories of recipients, only as reasonably necessary and subject to appropriate contractual safeguards: (i) service providers and processors that perform services on our behalf (such as website hosting, email delivery, analytics, payment processing, and customer relationship management); (ii) professional advisors, including attorneys, accountants, and auditors; (iii) government authorities, law enforcement, or other third parties when required by applicable law, regulation, legal process, or governmental request, or to enforce our rights; and (iv) successors in interest in connection with any merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets, in which case personal information may be transferred subject to this Policy.
We do not sell or rent personal information to third parties for monetary consideration.
Cookies and Tracking Technologies
We use first-party and third-party cookies and similar technologies to operate the Services, remember your preferences, measure traffic, and understand how users engage with our site. You may configure your browser to refuse cookies or alert you when cookies are being sent; however, certain features of the Services may not function properly without cookies.
We currently do not respond to "Do Not Track" browser signals because no uniform industry standard for such signals has been adopted. We will honor recognized universal opt-out mechanisms to the extent required by applicable law.
Your Rights Under the Virginia Consumer Data Protection Act
If you are a Virginia resident acting in an individual or household context, you have the following rights under the VCDPA, subject to verification of your identity and certain statutory exceptions: (1) the right to confirm whether we are processing your personal data and to access such data; (2) the right to correct inaccuracies in your personal data, taking into account the nature of the data and the purposes of processing; (3) the right to delete personal data provided by or obtained about you; (4) the right to obtain a copy of the personal data you previously provided in a portable and, to the extent technically feasible, readily usable format; and (5) the right to opt out of the processing of personal data for purposes of (a) targeted advertising, (b) the sale of personal data, or (c) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
To exercise any of these rights, please submit a request to hello@fluffnsuds.com. We will respond within forty-five (45) days as required by Va. Code § 59.1-577, with one (1) additional 45-day extension where reasonably necessary. If we decline to take action, you have the right to appeal our decision by replying to our response within a reasonable period, and we will respond to your appeal within sixty (60) days. If your appeal is denied, you may contact the Virginia Attorney General to submit a complaint at https://www.oag.state.va.us/.
Federal Communications and Marketing Compliance
Commercial email communications we send comply with the CAN-SPAM Act, 15 U.S.C. §§ 7701–7713. Every marketing email will include a functional unsubscribe mechanism, accurate header and sender information, a non-deceptive subject line, and our valid postal address. You may opt out of marketing communications at any time by using the unsubscribe link or by emailing hello@fluffnsuds.com; opt-out requests will be honored within ten (10) business days as required by the Act.
If we use any text-message (SMS) communications, those communications are conducted in compliance with the Telephone Consumer Protection Act ("TCPA"), 47 U.S.C. § 227, and its implementing regulations at 47 C.F.R. § 64.1200, and you may opt out at any time by replying STOP.
Children's Privacy
The Services are intended for users who are at least eighteen (18) years of age. We do not knowingly collect, use, or disclose personal information from any child under the age of thirteen (13) in violation of COPPA, 15 U.S.C. §§ 6501–6506, or any personal data from a known child as defined under Va. Code § 59.1-575. If you believe a child has provided personal information to us, please contact us immediately and we will promptly delete such information from our records.
Data Security
We implement and maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, and destruction, consistent with the security obligations of Va. Code § 59.1-578(A)(2) and applicable federal guidance, including standards published by the National Institute of Standards and Technology (NIST).
Notwithstanding these measures, no method of transmission over the internet or method of electronic storage is one hundred percent (100%) secure, and we cannot and do not guarantee absolute security. In the event of a security incident affecting your personal information, we will notify you and applicable regulators as required by Virginia Code § 18.2-186.6 and other applicable breach-notification laws.
Data Retention
We retain personal information only for as long as is reasonably necessary to fulfill the purposes set out in this Policy, comply with our legal, tax, accounting, or reporting obligations, resolve disputes, and enforce our agreements. When personal information is no longer required, we will securely delete, destroy, or anonymize it.
Third-Party Websites and Services
The Services may contain links to websites, applications, or services that are operated by third parties and not owned or controlled by FluffNSuds. We are not responsible for the content, privacy practices, or terms of use of such third parties. We encourage you to review the privacy policies of any third-party site before submitting personal information.
Changes to This Policy
We reserve the right to modify this Policy at any time. Material changes will be communicated by posting the revised Policy on this page with a new "Effective Date." Your continued use of the Services after the Effective Date of any revised Policy constitutes your acceptance of the updated terms to the fullest extent permitted by law.
